First: Rental Basis

The customer undertakes that if they provide incorrect information at the time of rental, the rental company has the right to consider the car stolen and report it to the authorities.
The minimum daily rental period is one day (24 hours).
The contract duration is extendable with the agreement of both the rental company and the customer, provided that it is specified in the contract through the company’s branches, before the contract's expiration date according to the necessary procedures.
The value of the delay hours beyond the specified return time is calculated -for a maximum of four hours-, according to the following formula: [(Daily Rental Rate × Number of Delay Hours) / 24] × 2 = Cost of Delay Hours.
The rental company has the right to terminate the contract before its expiration if the customer returns the car. In this case, the rental company has the right to demand the customer for the actual rental duration or the full contract duration as agreed upon in the contract.
Any part of an hour of delay is calculated as a full hour.
If the customer does not request an extension of the contract, or if the rental company does not agree to the extension, the customer will bear additional costs for the extra period until the car is returned to the rental company or retrieved, equivalent to 100% (one hundred percent) of the daily rental rate if the delay exceeds four hours, in addition to the agreed rental costs in the contract, including coverage of accident costs, traffic violations, and any damages.
If the car is delayed for more than (48) hours from the specified return time, the company has the right to notify the relevant authorities to take necessary actions, and the company also has the right, in case of contract violations, to retrieve the car through the relevant authorities.
No modifications by the customer or the rental company to the contract are allowed after signing except with the consent and approval of both parties.

Second: Obligations of the Rental Company

The rental company acknowledges and commits to the following:

Ensuring the car is in good condition and safe for use.
In case of any technical defect in the car that is not due to the customer’s fault or negligence, the car will be replaced with another one of the same category. If unavailable, it will be replaced with a higher category car at no additional cost to the customer; otherwise, it will be replaced with a lower category car according to the announced tariff.
Accepting the car that has been in an accident immediately upon being notified, considering the date and time of the accident report as the end of the rental contract. However, if the car is seized by security and government authorities due to the customer’s fault, the customer will bear the rental cost until the car is actually received.
Verifying the original ID and driver's license.

Taking full responsibility for not verifying the following:

The identity of the customer and those authorized to drive the car and obtaining a copy of it.
A valid driver’s license for the driver, whether it is the customer or those authorized under the contract to drive the car, and obtaining a copy of it.
Including in the contract how to cover damages resulting from accidents, covering liability towards third parties as well as the authorized driver under the contract and the passengers.
Not refusing, for any reason, to receive the car from the customer upon its return.

Third: Obligations of the Customer

The customer acknowledges the accuracy of all the information mentioned in the contract upon signing and commits to the following:

The car:

The car and all its components, including tires, engine, tools, equipment, documents, and others, are owned by the rental company.
The car has been rented to the customer for personal transportation purposes only and not to be rented to others.
The customer has no right to make any modifications to the car and its equipment, including tampering with the odometer or removing the rental company’s identification sticker.
The customer has ensured that the car is suitable for their use.
The customer must use the fuel and oils specified by the rental company in the contract while operating the car.
The car must be returned with the same amount of fuel as at the time of receipt.

Returning the Car:

The car must be returned to the specified location, on the date and time mentioned in the contract, and in the same operating condition as received, considering normal consuming level during the rental period.

Retrieving the Car:

The rental company has the right to retrieve the car through the competent authority and at the customer’s expense without any prior notice in the following cases:

Failure to return the car at the specified date and time.
Using the car in violation of the contract terms.
If it is found that the customer provided incorrect information at the time of rental.

Drivers:

The authorized drivers of the car are:

The customer, if they hold a valid driver’s license qualifying them to drive the car.
The person or people authorized by the customer who hold valid driver’s licenses qualifying them to drive the car, and whose details are recorded in the contract.
Employees of the competent authorities in emergencies.

Fourth: Conditions of Use

The customer undertakes that the car will not be used in the following cases:

By people not authorized under the contract to drive the car.
If the car needs repair or regular maintenance.
If operating the car will cause damage to the engine or any of its parts.
If the authorized driver under the contract is unable to drive the car, such as being under the influence of alcohol or drugs, or having a health condition that impairs safe driving.
Transporting people or goods for a fee.
Participating in car races.
Pushing or pulling other cars.
Using the car in a negligent or careless manner by the customer.
Towing a trailer without the rental company's approval.
Using the car on rough, unpaved roads or roads not intended for car driving.
Driving trainings.
Leasing the vehicle to others.
Using it for purposes contrary to the regulations of the Kingdom of Saudi Arabia.
Using it outside the Kingdom of Saudi Arabia unless agreed upon in the contract.

Fifth: Leaving the Car

Do not leave the car with the ignition key inside.

Sixth: Insurance

Comprehensive Insurance:

The rental company provides comprehensively insured cars, covering liability for accidents towards third parties in addition to the rented car, its driver, and its passengers, for a deductible amount payable by the customer according to the category of the rented car and under the following terms and conditions:

The customer must be at least 21 years old and not more than 70 years old.
The customer must meet the insurance companies' requirements according to the laws of the Kingdom of Saudi Arabia.
The contract must be valid at the time of the accident.
The customer must notify the rental company and the authorities immediately in the event of an accident or theft of the car, providing all requested information and obtaining a traffic report from the relevant police stations.

The insurance does not cover accidents in certain cases, and therefore the customer will bear full responsibility towards third parties or the rental company. These cases include:

Not adhering to general traffic rules, such as running a red light, driving in the wrong direction, or driving under the influence of intoxicants or drugs.
If the driver is not authorized under the contract to drive the car.
If the accident occurs after the contract period has expired.
Using the car for purposes other than those agreed upon.
If the accident occurs outside the Kingdom of Saudi Arabia, and it was not agreed in the contract to use the car outside the Kingdom.
If the car is stolen due to the customer's negligence or stolen with the ignition key inside or stolen outside the Kingdom of Saudi Arabia without agreement in the contract to use the car outside the Kingdom.
If the rental company is not provided with a report from the traffic police, Najm, or the police.

Additional Insurance:

The rental company offers the customer additional insurance for an extra daily fee on top of the daily rental rate, which exempts the customer from the deductible amount in the event of an accident. However, the customer is not entitled to a refund of the additional insurance amount if no accident occurs.

The additional insurance is voided in the event of a collision with a stationary object, or if the customer is the victim of a hit-and-run and the car is returned without a report from the relevant official authorities. In such cases, the customer bears all the costs resulting from the accident.

The additional insurance is added under the following conditions:

The customer requests additional insurance only at the time of opening the contract.
The customer meets the insurance companies' requirements according to the laws of the Kingdom of Saudi Arabia.
All conditions mentioned in the comprehensive insurance section apply to the customer.

Seventh: Reporting Accidents and Impounding of the Car

The customer must notify the rental company and the authorities immediately in the event of an accident or discovering the car has been stolen, providing all the required information.
The customer must notify the rental company immediately if the car is impounded by the authorities for any reason.

Eighth: Rights of the Rental Company

The customer may not waive the rental company’s rights to any other party.
The customer may not represent the rental company before the authorities.

Ninth: Regular Maintenance and Breakdowns

The customer must return the car to the rental company for any repair due to a sudden breakdown or notify the rental company if the car is not roadworthy so that the rental company can retrieve it.
The customer must return the car to the rental company if it requires regular maintenance according to the car manufacturer's system and its authorized dealer in the Kingdom of Saudi Arabia.
In both of the above cases, the customer is not entitled to make any repairs to the car unless approved by the rental company.

Tenth: Violation of Regulations and Instructions

The customer bears full responsibility and costs for the following:

Traffic violations caused by the driver during the contract period or while the car is with the customer.
Any other violations resulting from misuse of the car or using it for illegal purposes according to the traffic and transportation regulations in the Kingdom during the contract period or while the car is with the customer.
In the event of an accident or theft outside the Kingdom of Saudi Arabia, unless agreed in the contract to use the car outside the Kingdom.
In case of not returning the car.

Eleventh: Customer’s Personal Belongings

The rental company is not liable for any compensation to the customer for any personal belongings left in the car.

Twelfth: Rental Costs

The customer bears the following costs during the contract period or the car usage period:

The car rental costs for the entire rental period and any extension thereof or the period used without contract extension according to the contract terms based on the actual contract duration and the actual contract type (daily/weekly/monthly/annual) which is determined only upon returning the car. The estimated contract value is based on the expected return date specified by the customer and the daily rental rate may vary if the car is returned before or after the specified date by the customer when opening the contract, affecting the calculation method and using the basic daily rental rate mentioned in the contract.
The rental cost is calculated at the actual time of returning the car, not the expected duration stated in the contract.
The insurance costs agreed upon in the contract.
The costs of contract additions (unlimited kilometers/international authorization/drop-off in another city fees/navigation system/child seat) agreed upon when opening the contract.
Contract additions do not include free hours.
The cost of fuel, oil, water, and tire air refills during the rental period.
Costs resulting from misuse of the car.
Traffic violation costs caused by the driver.
Costs resulting from violation of regulations and laws.
Fees for using public parking.
Costs resulting from the loss, replacement, or tampering with any car parts and equipment.
Costs of delaying the return of the car at the specified date and time according to the basic rental rate specified in the contract, including covering the costs of accidents, traffic violations, any damages, and any amounts borne by the rental company during the customer's car usage period.
The cost of the fuel in the car at the time of rental if it is not returned with the same fuel level when opening the contract, calculated at the fuel price in the Kingdom of Saudi Arabia plus a financial penalty.
Costs of damages not covered by insurance as agreed upon in the contract.
Costs resulting from waiving the rental company’s rights to others.
Costs of repairing any modifications to the car made by the customer without the written approval of the rental company.

Thirteenth: SIMAH Approval

Hereby, I the undersigned (Agent/Authorized person on behalf of the Business/Company), agree to provide Al Yam Rent a Car co. with any information that it requires for the establishing and/or auditing and/or my facilities therewith and I authorize it to obtain and collect any information as it deems necessary or in need for regarding me, my facilities therewith, from the Saudi Credit Bureau (SIMAH) and to disclose and share (inclusive of Data Pooling) that information to the said company (SIMAH) or to any other agency approved by Saudi Arabian Monetary Agency (SAMA).

Fourteenth: Promotional Messages

I agree to receive promotional messages from Al Yam Rent a Car as well as messages related to the current booking.
